1. How the Platform Works
1.1 Building Relationships
- On the "Refurbished.store" platform, made available by the company Refurbished.store International B.V. via www.refurbished.store and other domains or applications, consumers can:
- Purchase refurbished electronic products from registered professional sellers;
- Resell refurbished electronics to professionals by individuals, consumers, or professionals so that they can refurbish and resell them.
- Refurbished.store International B.V. acts as an intermediary between Sellers and Buyers and is in no way a seller or buyer of the Products on the Platform, which are sold directly by the Sellers to the Buyers.
1.2 Financial Terms
- Buyers pay for their product directly on the platform through a trusted payment provider. Sellers authorize Refurbished.store International B.V. to receive the amounts paid by Buyers, on behalf of and in the name of the Sellers.
- The prices of the products and delivery costs are freely determined by the Sellers.
- Sellers must pay Refurbished.store International B.V. a commission on all confirmed transactions carried out by the Seller on the Platform. The amount of the commission is equal to a fixed percentage of the transaction amount, including all taxes (including shipping costs).
1.3 Warranties and any insurance
- The applicable legal warranties and the commercial warranty offered by the Sellers are specified in the general terms and conditions.
- To exercise his rights, the Buyer can log into his customer account and contact the seller of the relevant order, or by sending an email to service@refurbished.store.
2. Terms for sales, removal of products, and ranking
2.1 Sales
- The platform only lists professional sellers. To be able to offer products for sale on the platform, sellers must open a seller account and in particular observe the following:
- The applicable regulations;
- The platform's quality criteria in terms of logistics management (delivery times, inventory management, quality of the delivered products). These criteria are specified in the seller's general terms and conditions and in the quality charter;
- Only offers relating to refurbished electronics may be published by Sellers on the Platform.
2.2 Removal of Products
- Refurbished.store reserves the right to remove a seller's products, either for convenience or for breach.
- Reasons for removing products due to default may include:
- Non-compliance with applicable law;
- Non-compliance with the general sales conditions or the quality charter.
- Refurbished.store reserves the right to remove products:
- Whose marketing would be prohibited or unlawful;
- That pose a danger to health, safety, or the environment;
- That are not repackaged;
- Offered by Sellers who have been removed themselves.
2.3 Ranking of refurbished product offerings
- The offerings on the results pages are ranked according to the best quality/price ratio of the products offered by the sellers, as determined by the algorithm developed by Refurbished.store International B.V.
- The main parameters taken into account by the Refurbished.store International B.V. algorithm for ranking the offers for sale are as follows:
- The price of the product;
- The evaluation of the product and the Seller by the Buyers (average of all evaluations given by consumers after receiving their product);
- The quality of the processing of the order by the Seller (percentage of defective products, percentage of poor products or accessories sent by the seller, percentage of products in poor aesthetic condition);
- The number of orders delivered late, canceled, and/or credited;
- The payment method.
3. Information about reviews posted on the Platform
- Only Buyers who have placed at least one order on the Platform can leave a review of the products and delivery.
- The Buyer can give a review from 1 to 5, and add a comment to his review. For certain products, the Buyer can give a specific review (quality/price ratio, delivery, packaging and cleanliness, overall performance, aesthetic aspect).
- The Buyer can leave a review by clicking on the link in the email sent to him approximately 1 week after the delivery of his/her product.
- The Buyer can also request at any time to delete his review by sending his request to the following address: service@refurbished.store.
- Refurbished.store International B.V. does not provide compensation in exchange for a review.
- Only reviews of purchased products are published. The maximum time between submitting a review and its publication is 1 working day.
- Reviews are ranked by our algorithm, taking into account in particular the review and the length of the review. They can also be ranked according to chronological order, relevance, highest rating, lowest rating, depending on the user's choice.
- Reviews remain online as long as the products they concern are offered for sale on the Platform.
- We publish positive and negative reviews without moderation before publication. After publication, any denigrating, offensive, or hurtful review may be removed at the request of an interested party by Refurbished.store, particularly in the following cases:
- If the review is used for advertising purposes
- If the review is published multiple times or with multiple accounts
- If the review is off-topic, or if the review is about the purchasing experience and not about the product.
- If the review is about a different product
- If the review encourages a purchase from a competitor
- If the buyer's review is inconsistent
- If the review contains comments or content that could be considered political or social, offensive, obscene, offensive, sexually explicit, libelous, or if the review constitutes a personal attack.
- If the review is false, misleading, or written by a Seller
- If the review is illegal or refers to illegal content
- If the review is protected by third party rights
- If the review is published as a result of identity theft
- If the review contains personal data or confidential information
- If the review incites hatred, discrimination, homophobia, xenophobia, racism, or violence.
- The request for removal of a denigrating, offensive, or hurtful review as described above must be sent by an interested party to the following address: service@refurbished.store.
4. EU Authorities
- If you are an authority of the EU Member States, the European Commission, or the European Digital Services Committee, you can directly contact Refurbished.store at the address "service@refurbished.store".
- This address can also be used by market surveillance authorities in the Member States to communicate directly with Refurbished.store about product safety issues. Communication to this address must be in English or Dutch.
5. Dispute Resolution
- In the event of a dispute relating to the conclusion, execution, interpretation, or validity of the terms of use or the relationship with Refurbished.store International B.V., the Buyer and Refurbished.store International B.V. are invited to take the necessary steps to reach an amicable settlement of their dispute.
- The Buyer is informed that he/she, if he/she wishes, can free of charge use a consumer mediator for the amicable settlement of the dispute with Refurbished.store International B.V. In this regard, the Buyer can use the free online dispute resolution platform set up by the European Commission and available by clicking on this link.
- If the Buyer does not wish to use mediation, if mediation has been unsuccessful, or if other steps that the Buyer could have taken to try to reach an amicable settlement for his dispute with Refurbished.store International B.V. have failed, the Buyer may submit the matter to the competent court of the place where he/she resided at the time of the conclusion of the contract or of the occurrence of the harmful event, of the place where Refurbished.store International B.V. is established or of the place of the actual delivery of the Product.
